1. Who we are and agreement to these terms

These Terms govern your use of the Jiyn website, desktop app, browser extension and related services (the "Service"). By creating an account, starting a trial or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for an organisation, you confirm you're authorised to accept these Terms for it.

2. Eligibility and accounts

• You must be at least 16 years old, or the age of majority where you live if that's higher for entering contracts, to use the Service.
• Keep your login details secure and tell us promptly about any unauthorised use. You're responsible for activity on your account.
• Each subscription may be used on up to 3 devices by one person. Sharing an account with others isn't permitted.

3. What Jiyn does

Jiyn simulates human typing: it enters text you provide into a document or app you choose, over a time you set, with variations in speed, pauses, typos and corrections. Optional features include formatting, scheduled sessions, a personal typing profile and (on Pro+) cloud typing into Google Docs. Features differ by plan and may change over time.

Jiyn depends on third-party software (your operating system, browser, Google Docs, Microsoft Word and others) that can change without notice. We don't guarantee that every feature will work in every app, editor or setting.

4. Acceptable use

You agree not to use the Service to:

• misrepresent authorship: present text as written by you, or by a particular process, in order to deceive a teacher, school, examiner, employer, client, publisher or anyone else entitled to know how it was produced;
• commit academic misconduct, or break the rules of any school, employer, exam, contest or platform;
• impersonate anyone, commit fraud, or create fake reviews, records or documents;
• type content you don't have the right to use, or that is unlawful, defamatory, harassing or infringing;
• send spam or automate actions on services that prohibit automation;
• type into documents, accounts or systems you aren't authorised to use;
• reverse engineer, resell, sublicense or circumvent the Service's licensing, limits or security, except where the law expressly allows it.

We may suspend or close accounts that break these rules, and we may cooperate with lawful requests from schools, employers or authorities.

5. Plans, trials and billing

• Plans. We offer a Free plan with limits, and paid Pro and Pro+ plans billed monthly or yearly. Current prices and what each plan includes are shown on our website and at checkout.
• Free trial. Paid plans may start with a 7-day free trial. A payment method is required. Unless you cancel before the trial ends, your paid subscription starts automatically and you'll be charged the price shown at checkout. We'll email you before a trial converts.
• Automatic renewal. Subscriptions renew automatically at the end of each billing period, at the then-current price, until you cancel. Prices are in [CURRENCY] and exclude applicable taxes, which are added at checkout.
• Cancelling. Cancel anytime from your account page (Manage billing). Cancellation stops future renewals; you keep access until the end of the period you've paid for.
• Price changes. We'll give you at least 30 days' notice of a price increase, which applies from your next renewal after the notice.
• No refunds. Payments are non-refundable, including for partial or unused periods. To avoid a renewal charge, cancel before the next billing period starts. The limited exceptions (billing errors, and accounts we close without cause) are in our Cancellation & Refund Policy. Nothing in these Terms limits refund rights you have under law.
• Payments are processed by Stripe (or another payment provider we tell you about). We never see or store your full card number.

6. Your content

You keep all rights to the text and documents you use with Jiyn ("Your Content"). On the desktop app and extension, Your Content stays on your device. If you use Cloud mode, you allow us to process Your Content only to type it into the documents you choose, as described in the Privacy Policy. You confirm you have the right to use Your Content this way.

7. Third-party services

The Service works with services we don't control, including Google Docs, Microsoft Word, your browser and payment providers. Your use of them is governed by their own terms. If you connect your Google account for Cloud mode, we access only the documents you select, and you can disconnect at any time.

8. Licence and ownership

While your account is in good standing, we give you a personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose under these Terms. We and our licensors own the Service, including its software, design and trademarks.

9. Changes and availability

We may update, add or remove features. We'll tell you in advance about changes that materially reduce what a paid plan includes, and you may cancel if you don't agree. We aim for the Service to be reliable but don't guarantee it will be uninterrupted or error-free.

10. Disclaimers

To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that typed output will be free of errors, that sessions will run at scheduled times, or that the Service will meet any requirement of a school, employer or platform.

Always review documents after Jiyn has typed into them.

11. Limitation of liability

To the extent permitted by law, we won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, documents, grades, employment, profits or business, arising from or related to the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and CA$100.

Some jurisdictions don't allow certain limitations, so some of the above may not apply to you. Nothing here limits liability that can't be limited by law.

12. Indemnity

You agree to indemnify and hold us harmless from claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or Your Content, to the extent permitted by law.

13. Suspension and termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or others. If we terminate a paid account without cause, we'll refund the unused portion of your current period.

14. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Before starting any formal proceeding, please contact us so we can try to resolve the issue informally. Subject to any consumer protection law that gives you the right to bring proceedings where you live, disputes will be heard by the courts of Ontario.

15. Changes to these Terms

We may update these Terms. If a change is material, we'll notify you by email or in the app at least 30 days before it takes effect. Continuing to use the Service after that means you accept the updated Terms.

16. General

These Terms, with the Privacy Policy and Refund Policy, are our entire agreement about the Service. If any part is unenforceable, the rest stays in effect. Not enforcing a right isn't a waiver of it. You may not transfer these Terms without our consent; we may transfer them as part of a merger or sale of our business.
